General Rental Conditions for Bikes
Article 1 – Purpose of the Contract:
The rental of an Electric Assisted Bicycle (e-bike), with or without accessories, equipped with the basic gear provided. The e-bike/hybrid bike/mountain bike, its accessories, and its basic equipment rented under this agreement, whether taken individually or collectively, are referred to as the "rented goods."
Article 2 – Basic Equipment of the Bike:
Each rented e-bike/hybrid bike/mountain bike is equipped with: front and rear lighting, battery with key, assistance control terminal, and bell.
The rental service also offers various accessories available for additional rental.
Article 3 – Obligations of the Renter:
The rental contract is concluded directly with the renter in person. Therefore, it is neither transferable nor assignable. The client, referred to as the "renter," must be a natural person over 18 years old, acknowledging their ability to ride a bike and having no medical contraindications. Users must be at least 14 years old, with a minimum height of 1.45 meters. Any minor must be accompanied by a responsible adult. For minors, the legal guardian agrees to assume all responsibility for any damage caused directly or indirectly by the minor as a result of the rental. The renter declares that they hold personal liability insurance for the use of the e-bike/hybrid bike/mountain bike.
The e-bike/hybrid bike/mountain bike being under the responsibility of the renter, it is recommended that the renter conduct a basic check of the bike’s main functional components before use, including (but not limited to) ensuring the saddle and pedals are properly secured, the brakes are functioning correctly, and the general condition of the frame and tires is good. The renter acknowledges that the bike is rented in perfect working condition and agrees to use it with care. In case of a technical failure of the bike during the rental period, the renter cannot claim any damages from the rental service. If repairs are needed, the renter must go to the rental location. The bike will either be repaired or exchanged. Only the "rental service" is authorized to determine whether the repair is due to normal wear and tear, a hidden defect, and therefore the responsibility of the rental service, or if the repair is caused by damage incurred during the rental, and therefore the responsibility of the renter, who will bear the corresponding costs. The rental service reserves the right to deduct the amounts due from the security deposit or charge the customer according to the rates displayed at the rental location.
Article 4 – Conditions of Use:
The renter agrees to use the rented goods personally. Lending or subletting the rented goods is strictly prohibited. The renter is personally responsible for any violation of the Highway Code as well as for any bodily injury or material damage caused during the use of the rented equipment in their care. The renter is strongly advised by the rental service to wear a helmet. The renter acknowledges that a helmet has been offered to them by the rental service. The renter may use the e-bike/hybrid bike/mountain bike on roads, bike paths, and accessible paths. The renter agrees not to use the e-bike/hybrid bike/mountain bike beyond their capabilities.
For routes requested by the renter, the rental service is in no way responsible for any incidents that may occur along the way, regardless of the cause.
The renter is prohibited from using the e-bike/hybrid bike on unpaved paths or paths reserved for mountain bikes. The renter will be informed of the battery's autonomy upon departure. In case of battery depletion, the rental service is not responsible.
The renter agrees not to modify or add anything to the e-bike/hybrid bike/mountain bike and accessories.
During each period of non-use, the renter agrees to always lock the bike frame and rear wheel to a fixed support (post, barrier, etc.) using the provided lock. The use of the luggage rack is strictly limited to carrying a double pannier with a capacity of 20 liters and a maximum weight of 22 kg. It is forbidden to transport a person. Sharp turns and descents must be negotiated with utmost caution, and the cyclist must maintain control of their speed at all times.
Article 5 – Ownership:
The rented goods remain the exclusive property of the rental service for the duration of the rental. The rental agreement transfers the legal custody of the e-bike/hybrid bike/mountain bike to the renter, and activates the renter's "liability insurance" in case of theft and for all damages they may cause during the use and possession of the rented goods, until the e-bike/hybrid bike/mountain bike is returned to the rental point.
Article 6 – Commencement, Availability, and Return:
The rental begins when the renter takes possession of the rented goods, which are delivered to them. This contract is only valid for the duration of the rental period. If the renter keeps the e-bike/hybrid bike/mountain bike and accessories beyond the rental period without regularizing their situation, they forfeit the benefits of the guarantees provided in the contract.
The renter acknowledges receiving the rented goods in good working condition, along with the basic equipment. The renter declares that they have had the opportunity to personally inspect the condition of the rented goods. They agree to return the goods in the same condition in which they were rented, taking into account only normal wear and tear.
No refund will be granted for early return of the rented goods.
Article 7 – Liability:
The renter releases the rental service from any liability arising from the use of the rented goods, particularly regarding the bodily, material, and immaterial consequences of accidents of any kind. The renter declares that they hold personal civil liability insurance that covers the liability incurred during the use of the rented goods, both by themselves and by those in their care.
The renter personally assumes responsibility for any damage, breakages, and theft of the rented goods. Damages, theft, or loss of the rented goods will be charged to the renter.
Article 8 – Deposit:
For each rental, the renter deposits a deposit via a credit card imprint for each rented bike. This deposit is not charged during the rental period. Upon return of the rented goods, the deposit is canceled.
The renter authorizes the rental service to charge the deposit for any costs related to repairs, damages, or theft, as specified above. It is understood that the amount of the deposit does not constitute a limit of liability, and the rental service retains the right, if necessary, to pursue the renter in order to obtain full compensation for any damages.
Article 9 – Assistance:
The renter rents the e-bike/hybrid bike/mountain bike in perfect working condition. They must ensure that the e-bike/hybrid bike/mountain bike is either returned or brought back to the rental point in the event of a mechanical issue.
Article 10 – Miscellaneous Provisions:
In case of non-performance by the Renter of any of their contractual obligations, the rental service may, by right, terminate the rental agreement early, without prejudice to any other rights. This agreement is governed by French law.
Article 11 – Dispute:
In case of any dispute regarding the execution, interpretation, or termination of this contract, the competent court shall be that of the registered office of the Lessor, MORVAN BIKE, to which the parties grant exclusive jurisdiction.
Article 12 – Definitions:
Accident: Any sudden, unforeseen event external to the damaged property and causing the damage.
Accidental material damage: Any deterioration or destruction of the E-bike and accessories due to an accident or fall, with or without an identified third party.
Theft: A sudden and unforeseen event resulting in the complete disappearance of the E-bike and accessories listed in the rental agreement.
Break-in: Forcing or destroying the lock device attaching the bike to a fixed point on the public road.
